Employer Terms & Conditions
These Employer Terms & Conditions (“Terms”) govern the registration and use of the BlueCollarJobs.ai platform (“Platform”) by individuals, firms, contractors, or companies seeking to hire workers (“Employer”).
By registering as an Employer on the Platform and selecting the option “I Agree,” the Employer confirms that they have read, understood, and agreed to be legally bound by these Terms, the Platform Privacy Policy, and all applicable laws of India.
If the Employer does not agree with these Terms, they should not access or use the Platform.
1. Acceptance of Terms
By completing the registration process and using the Platform, the Employer agrees to comply with these Terms & Conditions and any additional policies or guidelines issued by the Platform from time to time. Continued use of the Platform constitutes acceptance of these Terms and any updates that may be made in the future.
2. Employer Eligibility and Declaration
The Employer declares that they are a legally competent individual, firm, contractor, or company authorized to recruit or employ workers. The Employer further confirms that all information provided during registration and job postings is true, accurate, complete, and lawful. The Employer agrees to maintain the accuracy of such information and update it whenever necessary. Providing false or misleading information may result in suspension or termination of the Employer’s account.
3. Role of the Platform
BlueCollarJobs.ai functions solely as a technology platform that facilitates communication and connections between employers and workers. The Platform does not act as an employer, recruitment agency, contractor, or employment guarantor. The Platform is not a party to any employment agreement or arrangement between employers and workers. The Platform does not guarantee hiring outcomes, worker availability, worker qualifications, or the completion of employment arrangements. All hiring decisions and employment relationships are undertaken solely at the Employer’s discretion and responsibility.
4. Compliance with Laws of India
The Employer agrees to comply with all applicable laws of India relating to employment and labour practices. This includes compliance with regulations concerning wages, working hours, workplace safety, statutory benefits, social security obligations, and other legal requirements governing employment relationships. Any violation of applicable laws shall be the sole responsibility of the Employer.
5. Ethical Hiring and Worker Protection
The Employer agrees to ensure that all employment opportunities offered through the Platform are lawful and ethical. The Employer shall not engage in or promote any form of child labour, bonded labour, forced labour, or human trafficking. The Employer further agrees to treat workers with fairness, dignity, and respect and to provide working conditions that comply with applicable occupational health and safety standards.
6. Data Usage and Privacy
By registering on the Platform, the Employer grants consent to BlueCollarJobs.ai to collect, store, process, and use the information provided by the Employer for the purposes of account verification, job matching, communication, compliance, and improvement of platform services. The Platform may share relevant employer information with workers or authorized partners solely for the purpose of facilitating employment opportunities. All data processing shall be carried out in accordance with applicable data protection laws of India, including the Digital Personal Data Protection Act, 2023.
7. Communication Consent
By registering on the Platform, the Employer consents to receive communications from BlueCollarJobs.ai through phone calls, SMS messages, WhatsApp messages, email notifications, and platform alerts. Such communications may relate to account verification, job postings, worker applications, service updates, and platform-related notifications.
8. Prohibited Activities
The Employer agrees not to misuse the Platform or engage in activities that may harm workers, the Platform, or other users. This includes posting false, misleading, discriminatory, or unlawful job listings, requesting illegal payments or deposits from workers, engaging in harassment or exploitation, or using the Platform for any unauthorized or fraudulent purpose.
9. Account Verification, Suspension, and Termination
BlueCollarJobs.ai reserves the right to verify the identity and information of Employers registered on the Platform. The Platform may request additional documentation where necessary. The Platform also reserves the right to suspend or terminate Employer accounts or remove job postings without prior notice if violations of these Terms, complaints from users, or legal non-compliance are observed.
10. Limitation of Liability
BlueCollarJobs.ai shall not be liable for any losses, damages, disputes, or claims arising from employment relationships established through the Platform. The Platform is not responsible for the conduct, reliability, qualifications, or performance of workers or employers. All hiring decisions and employment outcomes occur solely at the Employer’s own risk and responsibility.
11. Indemnification
The Employer agrees to indemnify and hold harmless BlueCollarJobs.ai, its owners, employees, partners, and affiliates from any claims, damages, losses, liabilities, or legal proceedings arising out of the Employer’s job postings, employment practices, or violation of these Terms or applicable laws.
12. Intellectual Property
All intellectual property rights related to the Platform, including its software, technology, design, trademarks, logos, and content, are owned exclusively by BlueCollarJobs.ai. Employers shall not copy, reproduce, distribute, modify, or misuse any part of the Platform without prior authorization.
13. Platform Charges
Certain services on the Platform may currently be offered free of charge. However, BlueCollarJobs.ai reserves the right to introduce service fees, subscription plans, or premium features in the future. Employers will be notified before any charges become applicable.
14. Force Majeure
BlueCollarJobs.ai shall not be held responsible for any delay, interruption, or failure in providing services due to circumstances beyond its reasonable control. Such circumstances may include natural disasters, government actions, technical failures, internet disruptions, or cybersecurity incidents.
15. Modification of Terms
BlueCollarJobs.ai reserves the right to modify or update these Terms & Conditions at any time. Updated terms will be published on the Platform, and continued use of the Platform after such updates shall constitute acceptance of the revised Terms.
16. Governing Law and Jurisdiction
These Terms shall be governed by and interpreted in accordance with the laws of India. Any dispute arising out of or relating to the use of the Platform shall be subject to the exclusive jurisdiction of the competent courts located in Bhopal, Madhya Pradesh, India.
