Recruiting Agent Terms & Conditions
These Recruiting Agent Terms & Conditions (“Terms”) govern the registration and use of the BlueCollarJobs.ai platform (“Platform”) by individuals, firms, or agencies acting as recruiting or manpower agents (“Recruiting Agent”).
By registering as a Recruiting Agent on the Platform and selecting the option “I Agree,” the Recruiting Agent confirms that they have read, understood, and agreed to be legally bound by these Terms, the Platform Privacy Policy, and all applicable laws of India.
If the Recruiting Agent does not agree with these Terms, they must not access or use the Platform.
1. Acceptance of Terms
By completing the registration process and using the Platform, the Recruiting Agent agrees to comply with these Terms & Conditions and any additional policies, guidelines, or operational procedures issued by the Platform from time to time. Continued use of the Platform constitutes acceptance of these Terms and any future updates.
2. Agent Eligibility and Declaration
The Recruiting Agent declares that they are a legally authorized, competent, and where applicable, licensed individual, firm, or agency permitted to conduct recruitment or manpower placement activities. The Recruiting Agent further confirms that all information, documents, registrations, certificates, and licenses submitted to the Platform are true, accurate, valid, and up to date. The Recruiting Agent agrees to maintain the accuracy of such information and update it whenever required. Submission of false or misleading information may result in suspension or termination of the account.
3. Due Diligence and Recruitment Responsibility
The Recruiting Agent agrees to exercise reasonable and complete due diligence in all recruitment activities conducted through the Platform. This includes verifying the authenticity of employers, job roles, wages, working conditions, employment terms, and contractual obligations before sharing opportunities with workers. The Recruiting Agent shall also ensure the verification of worker identity, qualifications, skills, and consent for recruitment. The Recruiting Agent agrees to maintain transparency, fairness, and integrity in all recruitment processes and to take reasonable steps to prevent fraud, misrepresentation, exploitation, human trafficking, or any unlawful recruitment practices. Any failure in conducting proper due diligence shall remain the sole responsibility of the Recruiting Agent.
4. Compliance with Laws of India and Government Regulations
The Recruiting Agent agrees to comply with all applicable laws of India relating to labour, recruitment, immigration, and emigration. This includes compliance with regulations issued under the Emigration Act, employment and labour laws, and other relevant statutory provisions. The Recruiting Agent further agrees to comply with the rules, guidelines, advisories, and notifications issued by the Ministry of External Affairs (Government of India), including regulations governing overseas recruitment and foreign employment where applicable. The Recruiting Agent shall also ensure compliance with applicable international recruitment standards, bilateral labour agreements, and foreign country employment regulations where relevant.
5. Role of the Platform
BlueCollarJobs.ai operates solely as a technology platform that facilitates connections between employers, workers, and recruiting agents. The Platform does not act as a recruiting agency, employer, visa consultant, or contracting party. The Platform does not guarantee job placements, visas, overseas employment approvals, employment contracts, or recruitment outcomes. All recruitment activities, agreements, and employment arrangements remain the sole responsibility of the Recruiting Agent and the concerned employer.
6. Ethical Recruitment and Prohibited Practices
The Recruiting Agent agrees to conduct recruitment activities in a lawful, transparent, and ethical manner. The Recruiting Agent shall not charge illegal or unauthorized recruitment fees from workers, provide false or misleading employment information, engage in unauthorized overseas recruitment, or violate any applicable immigration, emigration, or employment regulations. The Recruiting Agent further agrees not to engage in practices involving forced labour, bonded labour, child labour, or any form of exploitation of workers.
7. Data Usage and Privacy
By registering on the Platform, the Recruiting Agent consents to the collection, storage, processing, and verification of submitted information for the purposes of platform operations, compliance checks, recruitment facilitation, and service improvement. The Platform may share relevant information with employers, workers, and authorized partners where necessary for recruitment processes. All data processing will be conducted in accordance with applicable data protection laws of India, including the Digital Personal Data Protection Act, 2023.
8. Account Verification, Audit, Suspension, and Termination
BlueCollarJobs.ai reserves the right to verify the identity, licenses, and documents submitted by Recruiting Agents. The Platform may conduct periodic checks or audits to ensure compliance with these Terms and applicable laws. The Platform may suspend or terminate a Recruiting Agent account or remove access to services without prior notice if complaints, regulatory concerns, or violations of these Terms are observed. Where required by law, the Platform may share relevant information with regulatory or law enforcement authorities.
9. Limitation of Liability
BlueCollarJobs.ai shall not be liable for any disputes, losses, claims, damages, or legal actions arising from recruitment activities conducted by the Recruiting Agent. The Platform is not responsible for employment contracts, visa approvals, employer commitments, or recruitment outcomes. All recruitment activities carried out through the Platform occur solely at the risk and responsibility of the Recruiting Agent.
10. Indemnification
The Recruiting Agent agrees to indemnify and hold harmless BlueCollarJobs.ai, its founders, employees, affiliates, and partners from any claims, liabilities, damages, losses, or legal proceedings arising from the Recruiting Agent’s recruitment activities, violation of applicable laws, or breach of these Terms & Conditions.
11. Intellectual Property
All intellectual property rights related to the Platform, including its software, technology, design, trademarks, logos, and content, belong exclusively to BlueCollarJobs.ai. Recruiting Agents shall not copy, reproduce, distribute, modify, or misuse any part of the Platform without prior authorization.
12. Platform Charges
Certain services on the Platform may currently be offered free of charge. However, BlueCollarJobs.ai reserves the right to introduce service charges, subscription plans, or premium services in the future. Recruiting Agents will be notified before any charges become applicable.
13. Force Majeure
BlueCollarJobs.ai shall not be held responsible for any delay, interruption, or failure in providing services due to circumstances beyond its reasonable control. Such circumstances may include natural disasters, government actions, internet disruptions, technical failures, or cybersecurity incidents.
14. Modification of Terms
BlueCollarJobs.ai reserves the right to modify or update these Terms & Conditions at any time. Updated terms will be published on the Platform, and continued use of the Platform after such updates shall constitute acceptance of the revised Terms.
15. Governing Law and Jurisdiction
These Terms shall be governed by and interpreted in accordance with the laws of India. Any dispute arising out of or relating to the use of the Platform shall be subject to the exclusive jurisdiction of the competent courts located in Bhopal, Madhya Pradesh, India.
